Welcome to Pinewood Garden Company! Please read our terms and conditions carefully to ensure that you understand and agree with our policies and practices.

1. General Scope of Services

a. We provide regular garden maintenance services, including but not limited to lawn mowing, brush cutting, hand weeding, pruning, plant care, debris removal, and waste disposal. The services are provided either on a fortnightly or monthly basis, based on the agreement with the client.

b. All-Year-Round Maintenance: We provide maintenance services throughout the year, with reduced hours during low-maintenance seasons like winter.

2. Service Agreement and Schedule

a. Services will be performed on a recurring basis or as agreed upon in the service contract.

b. The duration of each visit is typically 4 — 10 hours, which excludes time allocated for travel.

c. Any additional tasks requested by the client beyond the agreed services may incur additional charges and will require prior approval.

d. Changes to scheduled visits must be communicated at least 2 weeks in advance. Failure to provide notice may result in a cancellation fee of $200.

e. Good-Faith and Trust Policy: We value our relationship with clients and operate on principles of good faith and trust.

3. Payment Terms

a. Payments for services are due within 7 (seven) days of invoicing, which will be sent after each scheduled visit or as agreed upon depending on the service arrangement.

b. Invoicing: Each house or property is independent and will be invoiced separately.

c. All prices quoted are inclusive of GST at the rate of 15%, unless otherwise stated.

d. A late payment fee may be applied to invoices not paid within the due period. Continued non-payment may result in suspension of services.

e. Commercial Fees: Our invoices include commercial fees that cover our insurance and maintenance of commercial-grade power tools and vehicles.

f. Quote Estimates: All quotes are estimates unless explicitly stated as fixed quotes.

4. Client Responsibilities

a. Clients are expected to ensure the garden is accessible on the scheduled service day.

b. Any pets should be secured, and any hazards (such as tools or toys) should be removed from the work area.

c. We are not responsible for damage to irrigation systems, wires, or pipes that have not been clearly marked or communicated prior to service.

5. Weather and Conditions

a. In the event of extreme weather conditions (e.g., heavy rain, storms), we may need to reschedule services. We will notify the client in such cases and arrange an alternative date.

b. Garden conditions such as overgrown lawns, unmanageable hedges, or other unforeseen circumstances that require extra time may result in additional charges. The client will be notified of these charges prior to any additional work being carried out.

6. Liability

a. Public Liability and Business Insurance: Pinewood Garden Company is fully insured to cover any unforeseen events for the services provided. However, we are not liable for damage to plants, shrubs, or trees due to pre-existing conditions, disease, or natural causes.

b. We are not responsible for theft, loss, or damage to personal property unless caused by negligence on our part.

7. Service Guarantee

a. We aim to provide the highest standard of service. If for any reason you are not satisfied with the service provided, please notify us within 48 hours.

b. GPS Tracking: All our vehicles are equipped with GPS trackers to monitor their movements and ensure safety and efficiency.

c. No refunds will be provided for services already rendered unless agreed upon in advance due to exceptional circumstances.

d. Job Fulfillment Alternative Solutions: If we are unable to fulfill a job for a client, we will do our best to find an alternative solution or reschedule for another time.

8. Cancellation

a. Notice Period: A minimum notice period of 2 weeks is required for any cancellations.

9. Termination of Contract

a. Either party may terminate the service agreement with 1 month written notice.

b. Failure to comply with payment terms or repeated rescheduling of services may result in automatic termination of the agreement.

10. Changes to Terms and Conditions

Pinewood Garden Company reserves the right to update or amend these terms and conditions as needed. Clients will be informed of any significant changes in advance.

11. Governing Law

a. New Zealand Standard Practices & Compliance: Pinewood Garden Company adheres to all New Zealand standard practices and policies related to gardening, landscaping, and maintenance services.

b. Environmental Responsibility: We are committed to sustainable and environmentally-friendly practices in all our services.

c. These terms and conditions shall be governed by the laws of Aotearoa / New Zealand. Any disputes arising from these terms will be subject to the jurisdiction of the courts of Aotearoa / New Zealand.
